Terms of Service

Welcome to Oppad. These Terms of Service ("Terms") govern your access to and use of the Oppad community delivery marketplace at https://oppad.ai (the "Platform"). By creating an account or placing an order you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Platform.
1. Definitions
- Oppad, we, us: Oppad (Pty) Ltd, the operator of the Platform.
- Customer: a user placing an order through the Platform.
- Vendor: a business selling goods through the Platform.
- Driver: an independent contractor accepting delivery jobs through the Platform.
2. The Platform's role
Oppad is a technology platform that connects Customers with local Vendors and independent Drivers. The contract for the sale of goods is between the Customer and the Vendor; the contract for delivery is between the Customer and the Driver. Oppad acts as a payment collection agent for Vendors and Drivers and is not the seller of the goods, except where explicitly indicated.
3. Eligibility & account
- You must be at least 18 years old (or have the consent of a parent or guardian) to use Oppad.
- You must provide accurate information when signing up and keep it up to date.
- You are responsible for safeguarding the Google account you use to sign in.
- You may not create multiple accounts for the purpose of abusing promotions or evading suspension.
4. Orders, payment and refunds
- Prices, availability and delivery fees displayed at checkout apply.
- Payment is processed by a third-party payment provider; the relevant provider's terms apply to the payment transaction.
- Where an order cannot be fulfilled (e.g. the Vendor cancels), you will be refunded in full to your original payment method within 10 business days.
- Refunds for quality issues are at the Vendor's discretion under the Consumer Protection Act, 68 of 2008; Oppad will assist with the resolution.
5. Consumer rights
Nothing in these Terms limits your rights under the South African Consumer Protection Act, 68 of 2008, including your right to fair value, good quality and safe goods, and the right to return defective goods within a reasonable period.
6. Vendor obligations
- Vendors must hold any licences required by law to sell their goods (health, liquor, etc.).
- Vendors must accurately describe their products, including pricing, allergens and stock availability.
- Vendors must accept or reject incoming orders promptly via the Live Orders dashboard.
- Vendors are responsible for the quality and food safety of items they prepare.
- Oppad may suspend a Vendor at any time for breach of these Terms, for safety reasons, or for repeated negative customer feedback.
7. Driver obligations
- Drivers operate as independent contractors and not as employees of Oppad.
- Drivers must hold a valid driver's licence (where required for their vehicle), valid insurance, and comply with all traffic laws.
- Drivers must deliver food in a safe, hygienic manner.
- Earnings are paid out in line with the published payout schedule (currently weekly).
8. Acceptable use
You may not:
- Use the Platform for any unlawful purpose.
- Harass, threaten or discriminate against other users, Vendors or Drivers.
- Scrape, reverse-engineer or interfere with the Platform.
- Submit false reviews or otherwise manipulate ratings.
- Use the Platform to deliver prohibited goods (firearms, illegal substances, etc.).
9. Intellectual property
The Oppad name, logo, designs, source code and all related intellectual property are owned by Oppad (Pty) Ltd. You receive a limited, revocable, non-transferable licence to use the Platform for its intended purpose. Vendors retain ownership of any product imagery and descriptions they upload but grant Oppad a worldwide, royalty-free licence to display them on the Platform for the purpose of selling those products.
10. Liability
To the maximum extent permitted by law, Oppad's total liability arising from your use of the Platform in any 12-month period is limited to the fees Oppad earned from you in that period (typically the service fees on your orders). Oppad is not liable for indirect or consequential losses such as lost profits or lost opportunity. Nothing in these Terms excludes liability that cannot lawfully be excluded.
11. Privacy
How we handle your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. Read it carefully — it is aligned with POPIA.
12. Termination
You may close your account at any time by emailing support@oppad.ai. We may suspend or terminate your account immediately for breach of these Terms, for fraud, or for safety reasons. Termination does not affect rights and obligations that arose before termination (e.g. payment for completed orders).
13. Changes to these Terms
We may amend these Terms by posting a new version on the Platform. Material changes will be notified via in-app banner and (where applicable) email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the new Terms.
14. Governing law & disputes
These Terms are governed by the laws of the Republic of South Africa. The Magistrates' Court / High Court of South Africa has non-exclusive jurisdiction over any dispute. Before going to court the parties will attempt to resolve the dispute in good faith for at least 30 days.
